Terms and conditions

By accessing our services, you, the user, agree to the terms and conditions we set out here. These terms and conditions may change at our discretion any time, and without notice. All orders and purchases made through this site are also governed by these terms and conditions.

Use of and orders placed on this website are governed by the laws and the courts of the province of British Columbia, and by the applicable laws of Canada. The user is also responsible for complying with these laws. The United Nations Convention on Contracts for the International Sale of Goods will not apply.

We may correct errors or inaccuracies and change or update information on this website at any time without notice, including prices and item availability. All sizes and weights quoted are approximate if posted. All prices listed are in Canadian dollars and all charges will be processed in Canadian dollars. All prices listed on this site are subject to confirmation. You agree to pay all charges payable for your order. We reserve the right to limit the quantity of items that you may buy. We also reserve the right to cancel orders at our discretion.

We will use commercially reasonable efforts to deliver any deliverable items as quickly as possible, and within any time indicated. However, we are not responsible for delivery delays beyond our control. We will endeavour to notify users if delivery is delayed. All items are delivered by a third party, and delivery is governed by their shipping contracts. We reserve the right not to ship to certain addresses.

This site provides links to other websites. All those sites are independent from Overland Training Canada’s, and therefore we have no control over, and no liability for, those websites or their contents, or their use. We provide these links for your convenience, and you decide to access them at your own risk.

User approved content

By submitting content, users warrant that they have full right and authority to submit that content, and that they have sole copyright and proprietary right over that content. Users may not contribute, post or transmit unlawful, defamatory, or threatening material, that which would constitute or encourage criminal offenses, or violate any law. We reserve the right not to publish, or to remove, any content we deem inappropriate for any reason whatsoever.

Our liability

This website should be accessed and used at your own risk. Though reasonable efforts have been made to ensure the website is current and contains no inaccuracies or errors, no guarantees are made that the website’s content will be error-free, accurate, complete or current at all or any times. When a mistake is noticed, we will correct it as soon as possible and make reasonable efforts to notify affected users. This may mean that orders not yet shipped may be cancelled.

We are not responsible for lost, incomplete, illegible, misdirected or stolen messages or mail, unavailable connections, failed, incomplete, garbled, or delayed transmissions, online failures, hardware, software, or other technical malfunctions or disturbances, whether or not these circumstances affect, disrupt, or corrupt communications.

Overland Training Canada and our directors and employees are not liable for any damages arising out of or related to access to or use of our site, or sites we link to, whether or not these damages are foreseeable and whether or not we have been advised of the possibility, including, without limitation, direct, indirect, special, consequential, incidental or punitive damages.

This agreement between Overland Training Canada and you, the user, supersedes all prior agreements and understandings pertaining to this subject matter.

Gift vouchers and promotions

The use of gift vouchers fall under the following terms and conditions:

  • In order to purchase a Gift Certificate, you will need to register an account with us through our Website.

  • Gift Certificates ordered through our Website will be delivered automatically by electronic means to the email address you specify at the time of order. Our Gift Certificates include unique numbers and / or configurable patterns.

  • Our Gift Certificates / Contest Vouchers / Promotional Vouchers must be redeemed on our Website, as full or part payment of products from our Website. A Gift Certificate cannot be used to purchase a further Gift Certificate.

  • When ordering a Gift Certificate, you should ensure to enter the recipient’s email address correctly. We cannot be held responsible if the address is entered incorrectly and someone other than the intended recipient uses the Gift Certificate.

  • Site offers and promotions (including gifts with purchase and discounts) do not apply when purchasing gift vouchers.

  • All Gift Certificates / Contest Vouchers / Promotional Vouchers are dated and expire 12 months from the date of issue unless otherwise stated.

  • Gift Certificates / Contest Vouchers / Promotional Vouchers cannot be exchanged for cash.

  • Gift Certificates may only be redeemed against products purchased in the same currency as the Gift Certificate.

  • Where Products purchased online with a Gift Certificates / Contest Vouchers / Promotional Vouchers are returned, monies owing will be refunded by a Gift Certificate.

  • Contest or promotional vouchers may not be used in conjunction with any other promotion or discount.

  • We are not responsible if a Gift Certificates / Contest Vouchers / Promotional Vouchers is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.

  • All other promotion items are accepted in as is condition and are non-refundable.

  • All other promotion items cannot be exchanged for cash, gift certificates or other items.

  • Any subscription rewards are valid for the length stated in the promotion information, any re-occuring billing is the responsibility of the promotion winner.

  • The promotion winner accepts all liability relating to the reward and uses the reward entirely within their own responsibility and liability.

Assumption of risks

 Please be aware that the activities involve risks, dangers and hazards including, but not limited to: changing weather conditions and visibility; mechanical failure of equipment; difficulty or inability to control one’s speed, direction, stopping distances, and turning radius; variations or steepness of terrain; rolling or flipping vehicles; variation or changes in terrain surface including holes, depressions, loose gravel, exposed rock, pavement, snow ice, earth, mud and other natural objects; travel through or over streams, creeks, lakes, rivers and glaciers; collision with other vehicles, equipment, structures or objects; collision with exposed rock, snow, ice, earth, trees, tree stumps, forest deadfall or other natural or man made objects; rockslides, avalanches, encounters with wildlife; travel on highways and back country roads and trails; collision with persons or vehicles; becoming lost or separated from the guide or instructor or with other participants; slips and falls, drowning, hypothermia; failing to act safely or within one’s own ability or stay within designated areas; negligence of other personal and NEGLIGENCE ON PART OF OVERLAND TRAINING CANADA; INCLUDING THE FAILURE ON THE PART OF OVERLAND TRAINING CANADA TO TAKE ALL REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES. The terrain used for activities may be uncontrolled and not inspected, and hazards may be unmarked. Communication in the remote terrain which is sometimes used for the activities is difficult and in the event of an accident, rescue and medical treatment may not be readily available.

BE AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE ACTIVITIES AND FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE RESPONSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, VEHICLE DAMAGE OR LOSS RESULTING THEREFROM.

Drugs, alcohol and tobacco

Overland Training Canada’s priority is the safety and comfort of all of our participants, staff and observers. As such we adhere strictly to Federal and Provincial laws in regards to drugs (including marijuana), alcohol & tobacco consumption prior to or during any course or activity with Overland Training Canada. These laws are outlined within the Criminal Code of Canada and the Motor Vehicle Act of Canada. As a courtesy to other participants the consumption of tobacco products within close proximity of our staff, clients or observers is politely refused. Those that need to consume tobacco products may politely excuse themselves to somewhere safe and appropriate to do so, as long as fire restrictions, local & municipality bylaws are observed. Proper disposal of any waste product is mandatory.

Photo, sound and video release

During the booking process we will ask for your consent to having photos or videos taken of you whilst participating in the activities and to the publication of the photos and videos by the Releasees for advertising, marketing and promotional purposes. You may opt in or out.

It is forbidden, without the expressed prior written consent of Overland Training Canada to record any presentation, seminar, class, roundtable, discussion or any information sharing session by any means, including, voice, video and still photography.

Any images, voice recordings or video may not be shared in any form other than for personal use, this limitation includes any such sharing that relates to any other venture, business, be it related or not to Overland Training Canada without the expressed prior written consent of Overland Training Canada.

COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, provincial, and local governments and federal and provincial health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Overland Training Canada has put in place preventative measures to reduce the spread of COVID-19; however, we cannot guarantee that you will not become infected with COVID-19. Further, attending any of our in person services could increase your risk of contracting COVID-19.

You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending any training, guiding or services provided by us and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, our employees, volunteers, and program participants. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with my attendance of a program provided by the us (“Claims”). On my behalf, you hereby release, covenant not to sue, discharge, and hold harmless Overland Training Canada, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Overland Training Canada, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in of our in person programs.

You acknowledge that we will endeavour to limit the exposure to transmission of COVID-19 where possible, in conjunction to my own efforts, under the guidance of the WHO, PHAC, CDC, BCCDC, Government Of Canada and the Government of British Columbia

Cancellation policy

Please contact us immediately if you need to cancel or reschedule. Refund amounts vary according to the cancellation time and the product you are cancelling as per below:

Non qualification courses:

  • Full payment is due at the time of booking your reservation.

  • No refunds are available for cancellations within 48 hours of the course start date for single day programs.

  • No refunds are available for cancellations within 1 week of the course start date for multi day programs.

  • Cancellations OR re-bookings prior to 48 hours before the course start date are subject to a 25% per booking fee for your reservation at the discretion of Overland Training Canada for single day programs.

  • Cancellations OR re-bookings prior to 1 week before the course start date are subject to a 25% per booking fee for your reservation at the discretion of Overland Training Canada for multi day programs.
  • Full refunds will be provided if your booking is cancelled by us due to weather, mechanical failure, unsafe conditions, Government COVID19 regulations or any other reason deemed necessary by Overland Training Canada. Every effort will be made to rebook you on a suitable date as a priority before a full refund is issued.

Qualification courses:

  • Full payment is due at the time of booking your reservation or by commercial invoice, as approved by Overland Training Canada.

  • No refunds are available for cancellations within 1 month of the course start date.

  • Cancellations OR re-bookings prior to 1 month of the course start date are subject to 25% per booking fee for your reservation at the discretion of Overland Training Canada.

  • Full refunds will be provided if your booking is cancelled by us due to weather, mechanical failure, unsafe conditions or any other reason deemed necessary by Overland Training Canada. Every effort will be made to rebook you on a suitable date as a priority before a full refund is issued.

Return policy

If you are not entirely satisfied with your purchase, we’re here to help. 

  • You have 30 calendar days to return an item from the date you received it.

  • To be eligible for a return, your item must be unused and in the same condition that you received it.

  • Your item must be in the original packaging.

  • Your item needs to have the receipt or proof of purchase.

Refunds

Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item.

If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer’s policies.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non­refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
